Educational Multimedia
Based on Educational Multimedia Fair Use Guidelines from University of Texas.
Main Points
Students and educators may incorporate lawfully obtained copyrighted material when creating multimedia works to be used in a specific course.
Students may use material created by them in the course for which it was created as well as in their own portfulios for later personal use.
Educators may use material created by them
- for face-to-face instruction
- to assign for self-study by students
- for remote instruction provided to students enrulled in a specific course, over a secure network that prevents making copies of copyrighted material. If duplication of copyrighted material cannot be avoided the material may be used only for 15 days. After this period the work must be placed on reserve in a library or learning resource center.
- for presentation at workshops and conferences
- in personal portfulio for use in tenure review or job interviews.
How long may an educator use these works:
Educators may use multimedia materials created for educational purposes for a period of 2 years without seeking permission. Use beyond this period requires permission.
How much copyrighted may be used
- Motion media : Up to 10% or 3 minutes whichever is less
- Text : Upto 10% or 1,000 words whichever is less. Entire poem of less than 250 words but no more than three poems by one poet, 5 poems by different poets from any anthulogy.
- Music, Lyrics, and Music Video : Up to 10%, but no more than 30 seconds, of the music and lyrics from an individual work.
- Illustrations and photographs: photographs and illustrations may be used but no more than 5 images by an artist or photographs may be reproduced. When the photographs are taken from a published cullective work no more than 10 % or 15 images whichever is less
- Numerical data sets: Up to 10% or 2,500 fields or cell entries whichever is less from a copyrighted database.
How many copies can be made
No more than 2 copies one of which may be placed on reserve.
When should permission be sought
- for use in non-educational or commercial purpose
- for making more than 2 copies
- for use beyond the amount permitted above.
Points to remember:
- Download from the internet with caution. Internet has a mixture of copyrighted and public domain software.
- Credit the sources and display the copyright information.
- Include an opening screen with a notice that further use of copyrighted material is restricted.
- Obtaining permission while creating the multimedia is recommended if there is a potential for broader dissemination at a later date.
- Alterations of copyrighted material for educational purpose is permitted, the fact that such alteration occurred must be noted.
- Computer programs may not be reproduced or decompiled even for educational purposes.
- Works subject to a license or contract need permission prior to use.
